And it required 00:17:21.170 --> 00:17:25.329 a unique patient identifier to be issued by the 00:17:25.329 --> 00:17:28.789 federal government to every person. And it required 00:17:28.789 --> 00:17:32.190 a unique identifier for every doctor, for every 00:17:32.190 --> 00:17:35.589 employer, for every health plan. And then it 00:17:35.589 --> 00:17:39.309 had all of this digitization of our data without 00:17:39.309 --> 00:17:42.190 our consent. That's why it's called like the 00:18:42.099 --> 00:18:45.240 HIPAA law, the HIPAA rule, the HIPAA. notice 00:18:45.240 --> 00:18:47.759 of privacy practices. It's because of that one 00:18:47.759 --> 00:18:50.400 little section in which was in what was really 00:18:50.400 --> 00:18:54.400 an insurance portability bill. There's this 00:20:14.900 --> 00:20:16.880 little statement often in a consent form when 00:20:16.880 --> 00:20:19.279 you go to the doctor, to the hospital, and there's 00:20:19.279 --> 00:20:20.960 a number of things in the piece of paper, or 00:20:20.960 --> 00:20:25.799 sometimes it's its own form. But it says, I acknowledge 00:20:25.799 --> 00:20:29.799 or read or have received the notice of privacy 00:20:29.799 --> 00:20:32.920 practices. So they called it the notice of privacy 00:20:32.920 --> 00:20:35.980 practices. But if you read it, it is all the 00:20:35.980 --> 00:20:38.519 ways that that clinic or that hospital is going 00:20:38.519 --> 00:20:40.940 to share all of your information without your 00:20:40.940 --> 00:20:43.539 consent. But see, most people don't read it because 00:20:43.539 --> 00:20:46.000 they just believe the words. They believe what 00:20:46.000 --> 00:20:49.380 they were told. And so they've been deceived, 00:20:49.400 --> 00:20:51.720 and that was the entire intent. Now, you're just 00:24:19.920 --> 00:24:22.779 signing that you have seen it, but it's actually 00:24:22.779 --> 00:24:27.519 more thoughtful to do that because then you could 00:24:27.519 --> 00:24:29.700 actually maybe have a reason to look at that 00:24:29.700 --> 00:24:33.069 form. But now a lot of the clinics are coming 00:24:33.069 --> 00:24:36.410 out with no paper. They'll either do it online 00:24:36.410 --> 00:24:39.349 and ask you to do it before you ever get there, 00:24:39.589 --> 00:24:43.470 or they'll give you an iPad. And then it'll be 00:24:43.470 --> 00:24:46.710 click, click, fill in, click, click, click, click, 00:24:46.890 --> 00:24:48.349 and at one point you're going to get to the part 00:24:48.349 --> 00:24:51.190 where it says, I have received the notice of 00:24:51.190 --> 00:24:54.130 privacy practices. We are having 00:25:47.119 --> 00:25:50.160 some success with this campaign to get people 00:25:50.160 --> 00:25:53.420 to refuse to sign the HIPAA form, refuse to sign 00:25:53.420 --> 00:25:55.720 that acknowledgement statement of the notice 00:25:55.720 --> 00:26:00.220 of privacy practices. Just this summer, we've 00:26:00.220 --> 00:26:03.440 gotten sent to us two different consent forms, 00:26:03.940 --> 00:26:07.519 one that was all HIPAA, that's all it was. And 00:26:07.519 --> 00:26:09.940 at the bottom of it, it actually had a place 00:26:09.940 --> 00:26:13.400 for the clinic to check off that you had refused. 00:26:14.000 --> 00:26:16.619 And when you look at what the US Department of 00:26:16.619 --> 00:26:19.240 Health and Human Services says about the Notice 00:26:19.240 --> 00:26:21.799 of Privacy Practices and that Acknowledgement 00:26:21.799 --> 00:26:27.079 Statement, they say, by law, you are not required 00:26:27.079 --> 00:26:31.660 to sign that statement. And then the next few 00:26:31.660 --> 00:26:35.019 bullet points down, they say, your providers, 00:26:35.259 --> 00:26:39.319 when you refuse, they must sign that you have 00:26:39.319 --> 00:26:42.740 refused and date it. So this particular form 00:26:42.740 --> 00:26:46.380 that we got this summer was perfect. It had that 00:26:46.380 --> 00:26:48.039 language up there, you know, but then it had 00:26:48.039 --> 00:26:50.819 this whole section that said, patient refused, 00:26:51.119 --> 00:26:53.599 or patient was comatose and so couldn't sign, 00:26:53.660 --> 00:26:54.980 or, you know, they had different things that 00:26:54.980 --> 00:26:57.420 they could check off, right? And that's the way 00:26:57.420 --> 00:27:02.829 to do it. But the staff in the office sometimes 00:27:02.829 --> 00:27:06.109 has to be told that by law I don't have to do 00:27:06.109 --> 00:27:09.069 this. So I will just tell you the easiest way 00:27:09.069 --> 00:27:13.349 to do this is there are so many clinic staffs 00:27:13.349 --> 00:27:15.930 where the attorneys of the clinic have said, 00:27:16.390 --> 00:27:19.250 it's a HIPAA violation if you do not get them 00:27:19.250 --> 00:27:22.970 to sign. Well, this is completely bogus. That 00:27:22.970 --> 00:27:26.970 is not true. And even the HHS website says that's 00:27:26.970 --> 00:27:30.710 not true. But this is an easy thing. Lawyers 00:27:30.710 --> 00:27:32.970 just throw this out there, and clinics just believe 00:27:32.970 --> 00:27:35.630 it, and they go about their business until someone 00:27:35.630 --> 00:27:37.730 like you or me come in and say, yeah, no, I don't 00:27:37.730 --> 00:27:42.069 have to do that.
